Breast Implants Class Action

The case management judge has issued reasons on the claimant appeals and the final court orders have been entered. Accordingly, the Claims Administrator anticipates that cheques will be issued to claimants in the next few weeks.

All of our client’s claims were submitted to the Claims Administrator before the deadline of February 1, 2005. Payments have already been made to Approved Expedited, Current and Rupture Claimants.

Approved Expedited Claimants received a one time payment of $1,200 US. Approved Current and Rupture Claimants received their first payment in December 2005. The amount of the first payment was based on each claimant’s approved ratio. Further payments will be made to Approved Current and Rupture Claimants in the coming years. Approved Raw Material Claimants will receive a one time payment of $330 US later this year.

Update for the British Columbia Bristol-Myers, Baxter & 3M Breast Implant Litigation Settlement

All of our client’s claims were submitted to the Claims Administrator before the deadline of February 1, 2006. The Claims Administrator is currently reviewing the claims.

All of our clients’ claims were submitted before the deadline. Approved raw materials claimants will receive $330 US in 2006. Approved expedited claims will receive $1,200 US later this year. Approved disease claims will be paid in three annual installments. Although it was anticipated that the first installments would be paid in July or August 2005, there is a backlog of claims which will delay the payment until later this year. Cheques for disease claims will not be issued until the Claims Administrator has completed the claims review process and has determined how many eligible claims there are in each disease category. Once we have that information, we will update this message and provide an update by mail to all of our clients. Thank you for your continued patience.
