Pain Pump Class Action

Introduction

Light Cigs Class Action

On March 29, 2010, Mr. Justice Popescul of the Saskatchewan Court of Queen’s Bench certified a class action for Canadians injured by pain pumps. Persons covered by the lawsuit are all persons resident in Saskatchewan and elsewhere in Canada who used the defendants’ pain pump sold under the brand name “DonJoy Pain Control Device” and who claim to have suffered injury as a result of such use. The lawsuit concerns allegations that the DonJoy Pain Control Device causes chondrolysis when placed in the synovial cavity of a knee or shoulder following surgery. A copy of Mr. Justice Popescul’s decision can be obtained here. A copy of the Amended Statement of Claim which sets out the allegations in this lawsuit can be obtained here. A copy of Health Canada’s advisory concerning the risk of chondrolysis and pain pumps can be obtained here.
